It was not about a moral evaluation of prostitution. Monika gagel from the building administration office explained to the members of the building and environment senate only under which building law conditions residential prostitution, brothels and brothel-type businesses can be approved. Complaints had been received from neighbors, fellow residents and property managers, as well as from operators of licensed establishments, former operators, prostitutes and competitors.
"Since 2002, when prostitution was legalized as a business, there is no longer any moral evaluation", said monika gagel. Nevertheless, there are building regulations that have to be complied with. Prostitution is generally regarded as a commercial use that is disruptive to residential life and therefore requires a permit. Prostitution is not considered a liberal profession.
Brothels and brothel-type businesses are not permitted in pure and general residential areas. They also have no place in so-called mixed areas. In the city center, on the other hand, they are permitted, provided they do not cause any significant disturbance or their establishment is not excluded by a development plan. In commercial areas they are generally permitted. The situation is similar for residential prostitution. It is also not allowed in residential areas, but is permitted in mixed areas. The individual case must be examined here.
Under these conditions, the employees of the building administration office set to work. They researched on the internet and exchanged information with the public order office and the residents’ registration office. "We received rough support from the police", praises monika gagel. Finally, the result: 15 establishments were not eligible for approval. Use for prostitution has been informally or formally prohibited, depending on the specific case. In the past year, there were also ten cases of bribery in which 20,825 euros were recovered. Two appeals against the decision are currently pending . There have been eight informal applications, two applications for preliminary decisions and six planning inquiries on the subject of prostitution.
There are currently three licensed brothels or brothel-like establishments in coburg: in dieselstrabe, kanonenweg and eichhoeg. According to the building administration office, approved residential prostitution now only takes place in three apartments in creidlitzer strabe. Monika gagel admits, however, that there may also be a dark figure. "The businesses do not need a business permit"
and what possibilities are there from the point of view of building law to take action against prostitution in the city??
